Kovaleva v. Pichakchi and MTCC 1000 (Ontario Human Rights Tribunal) February 9, 2017

02/09/2017 – Jurisdiction Ontario
Part 57 published on 03/01/2017
Applicant permitted to continue human rights claim based on alleged age discrimination in relation to the applicant’s removal as a signing officer and as the President of the condominium corporation.

The applicant alleged that she had suffered harassment and discrimination and that she was the subject of adverse decisions, including her removal as a signing officer, her removal from the office of President, and her removal from the Board.

The Tribunal dismissed the claim in relation to the applicant’s removal (by vote of the owners) from the Board. The Tribunal said that there was no evidence to support that claim.

However, the Tribunal did not dismiss the claims in relation to the applicant’s removal (by the Board) as signing officer and as President.  Those claims might succeed, and were permitted to continue to a hearing.

[Editorial Note:  I just found it notable that such claims are possible – based upon alleged discrimination “in the social area of services”.]
