Condominium corporation obligated to obtain missing shared facilities committee minutes

The owner requested copies of certain shared facilities committee meeting minutes.  The condominium corporation said that the meetings did not occur, and there were therefore no minutes available for those meetings.  The owner presented evidence indicating that the meetings did in fact occur.

 

Even though the condominium corporation was apparently not responsible for preparation of the requested minutes, the Tribunal ordered the condominium corporation to obtain any available minutes and to provide them to the owner.  The Tribunal said:

 

 I order the Respondent to seek minutes of shared facilities meetings that occurred between November 25, 2020 and November 2021 that it has not already provided to the Applicant from the shared facilities committee and shared facilities management. Upon receipt of any further minutes, the Respondent is to provide them to the Applicant.
