Human Rights Claim dismissed.  The same matters had already been decided by the Civil Resolution Tribunal and Court

The Civil Resolution Tribunal had previously ordered Ms Yu to stop renting her unit on a short-term basis and this was followed by a contempt order (from the BC Supreme Court) when Ms Yu did not immediately abide by the order of the Civil Resolution Tribunal.  [See Condo Cases Across Canada, Part 66, June 2019.]

 

In the meantime, Ms Yu asserted a Human Rights claim in which she asserted that the actions of the strata corporation (in enforcing its by-laws against her) discriminated against her on the basis of her disability.  Ms Yu asserted that she needed to rent her unit on a short-term basis, to numerous tenants, because she needed the income due to her disability.

 

The Tribunal dismissed the Human Rights claim because “the issues that Ms. Yu seeks to raise in this human rights complaint are the same as were before the CRT and the BC Supreme Court.  As such, the substance of her complaint has been appropriately dealt with.”
