Management company awarded damages for condominium corporation’s improper termination of management contract
The condominium corporation terminated the management contract without notice, on the grounds that the manager had allowed unlicensed contractors to come onto to the premises after hours, to do work.
The Court said that there was no “cause” or fundamental breach, which would allow for immediate termination of the management contract; and the contract terms therefore only allowed for termination on 60 days’ notice. The Court said that the condominium corporation accordingly “must pay (the manager) the monies owing for 60 days it would have to pay (the manager) under the written management agreement during this 60-day notice period”.
