Tribunal orders that dog be removed.
The owner contravened the condominium corporation’s declaration and rules by allowing her dog to urinate and defecate inside her unit and on the exclusive-use balcony of her unit. The dog waste dripped from the balcony onto the balconies of the units below and caused odours originating from the owner’s unit and balcony.
The Tribunal held that the condominium corporation had properly declared the dog to be a nuisance in accordance with the corporation’s rules, and ordered that the dog be removed within 14 days.
