The Plaintiff applied, under Rule 18A of the Rules of Court, for an Order rescinding his agreement to purchase a strata lot from the Defendant. The Court granted the application. The Court held that the Plaintiff had a right of rescission under the Real Estate Development Marketing Act because the Defendant vendor had failed to give the Plaintiff all amendments to the Disclosure Statement respecting the development.
