Court orders appointment of administrator for two-unit strata corporation.

One of the strata corporation’s two owners had made unauthorized changes to the use and appearance of the common property (without the consent of the strata corporation).  This was a breach of the strata corporation’s by-laws; but the strata corporation had failed to take action.  The strata corporation had neglected its obligation to control the use of the common property because the corporation has only two members, and the strata corporation had been unable to pass a resolution because the two members were in conflict with one another.

The Court ordered that an administrator be appointed to exercise the powers and perform the duties of the strata corporation.
