Owner obligated to pay common expenses, despite claims against condominium corporation
The Plaintiff withheld common expense payments due to disputes over lack of maintenance, failure to provide financial notices, and incorrect billing of water charges to their unit. TSCC 2255 registered a lien against the Plaintiff’s unit, which stood at $974,703 as of the date of the hearing. The Ontario Superior Court ruled against the Plaintiff, holding that disputes over the corporation’s performance did not justify non-payment of common expenses (per Section 84 (3) of the Condominium Act).
