Owner had caused unreasonable noise by playing loud music
The Tribunal held that the owner of the unit had contravened the condominium corporation’s Declaration and rules as well as Section 117 (2) of the Condominium Act by playing excessively loud music, including during early morning hours.
After noting “indemnification” provisions contained in the condominium corporation’s Declaration and Rules, the Tribunal ordered the owner to pay the corporation’s “pre-CAT” costs and also to pay about 50% of the corporation’s “in-CAT” costs.
