Owner’s oppression claim dismissed. Condominium Corporation attended to required work in a reasonably prompt and professional way. Appeal dismissed.
The Applicant owned 35 of the 38 commercial units in the Condominium, which also contains 255 residential units in two towers. The Applicant claimed damages for oppression due to the Condominium Corporation’s alleged failure to quickly and properly address repeated water leakage, due to failing heat pumps. The Applicant’s claim was dismissed. [See Condo Cases Across Canada, Part 35, September 2011.]
The Applicant appealed to the Court of Appeal. The Appeal was dismissed.
