Court strikes owner’s statement of defence

The condominium corporation asserted a claim against one of the owners in relation to common expense arrears owed by the owner.  The owner filed a statement of defence claiming (as he had done in previous Court proceedings) that the condominium corporation had no basis to claim amounts against him.

 

The Court confirmed the authority of the condominium corporation to assert the claim and granted the condominium corporation’s application to strike the owner’s defence.  The Court said:  “The statement of defence is struck in its entirety without leave to amend or re-file a new statement of defence.”
