Court upholds Rule prohibiting smoking on the balconies
The condominium corporation passed a Rule to prohibit smoking on the balconies. The Court held that the Rule was properly passed and was a reasonable Rule – and therefore upheld the Rule. The Court also held that the condominium corporation had properly declined to include grandparenting of current unit owners (under the Rule).
The Court also said that the owners who attended the meeting (in person or by proxy) at which the Rule was passed could not subsequently object to the adequacy of the notice of the meeting.
