Court orders sale of strata lot

There was a previous Court order requiring that the owners comply with the strata corporation’s by-laws and that they pay fines levied by the strata corporation. [See Condo Cases Across Canada, Part 54, May 2016.]

 

The owners did not comply with that previous Court order.  On a further petition by the strata corporation, the Court ordered that the unit be sold.  The Court said:

 

I am satisfied beyond a reasonable doubt that the respondents are in contempt of the April 2016 order. I am also satisfied that no measure remains other than eviction that will suffice to protect the other residents in the strata and give them the quiet enjoyment of their property that they deserve.
