Legal costs of Syndicat, for collection of unpaid common expenses, must be reasonable.

The Syndicat was seeking repayment of legal costs incurred in its successful action for recovery of unpaid common expenses. The Court confirmed that the Syndicat was entitled to recover costs pursuant to a provision in the Syndicat’s Declaration, but said that the legal charges must be “reasonable and consistent with the value of the dispute”. 

The Court awarded $5,000.00 in costs, rather than the Syndicat’s claim of almost $10,000.00.
