Condominium Corporation not responsible for water damage
The plaintiff unit owner’s floor suffered $6,000 worth of water damage. She sued the condominium corporation for the costs of the damage, claiming that either the air-conditioner or the drainage system, both the responsibility of the corporation, was the source of the damage.
After considering the evidence of two experts, the Small Claims Court held that the plaintiff had not proven negligence on the part of the condominium corporation (even though there was no clear explanation for the origin of the water damage).
The owner’s claim was dismissed.
