Strata corporation entitled to special costs against unruly owners

The strata corporation was entitled to special costs from the owners of one of the strata lots, in the following circumstances:

  • The owners had willfully altered the common property without permission of, or notice to, the strata corporation.
  • One of the owners had prevented the strata corporation’s workman from accessing common property.  The owner had pushed down the workman’s ladder.
  • The owners had otherwise disrupted the normal repair efforts of the strata corporation.
  • The owners’ misbehavior had continued even after a Court injunction was obtained to restrain it.
