CAT issues various orders respecting owner’s request for records
The Tribunal’s orders included the following:
- The owner was not entitled to see “in camera” portions of Board meeting minutes, dealing with matters falling within the exemptions listed in Section 55 (4) of the Condominium Act.
- Management reports are generally to be considered drafts or notes that are not records of the condominium corporation. However, they may become records of the corporation to the extent that they are accepted by the Board and reflected in one or more Board meeting minutes.
- Notes of informal meetings are generally not records of the corporation. However, if the Board decides that such notes are to be inserted into the minute book or otherwise formally kept as records of the corporation, they can then become records of the corporation.
