Owners claim that scheduling a meeting on a religious holiday is discriminatory
The applicants are owners who self-identify as Muslim. They contend that the respondents (the condominium corporation and its manager) discriminated against them because of their creed, by holding a special owners’ meeting on the evening of October 16, 2013, which they allege was Eid-ul-Azha, an important religious holiday for Muslims. The tribunal ordered that the hearing of the matter continue in late January, 2015.
In the meantime, the tribunal dealt with requests, from the applicants, to amend their application to include allegations that the respondents had also infringed their rights under the Human Rights Code by holding a meeting on August 28, 2010 and by requiring or requesting a neighbouring property owner to close an opening in the fence between the neighboring property and the condominium property. Those requests were denied.
