Court enforces strata corporation’s rental restriction by-law
The Plaintiff leased one of the strata lots in order to provide furnished accommodation on a short-term basis (normally between 60 and 80 days) to its licensee clients.
The strata corporation had passed a by-law that restricted occupancies, including a prohibition of short-term occupancies (less than 180 days in duration). The question was whether or not the by-law applied to the plaintiff’s strata lot in light of section 143 of the Strata Property Act. On the particular facts of this case, the Court said that the by-law applied and section 143 did not.
