No discrimination in termination of strata corporation caretaker
The strata corporation terminated the employment of its caretaker. The caretaker claimed that the termination was discriminatory. The Human Rights Tribunal determined that the termination was not based, in whole or in part, upon the caretaker’s race, colour, ancestry, place of origin and/or age. There accordingly was no discrimination. The Tribunal’s decision included the following:
It was proper for the strata Council to seek the views of the owners about whether or not the caretaker should be replaced. The fact that one of the owners may have expressed discriminatory views about the caretaker did not lead to the inference that the Council’s decision was in any way based upon that view.
