deBoer v. Horizon Realty Ltd. (British Columbia Provincial Court)

12/01/15 – Jurisdiction British Columbia
Part 48 published on 01/11/14
Real estate agent not liable for purchaser’s claims respecting special levies

The plaintiff purchased a strata lot.  She subsequently sued her real estate agent, alleging that the agent was negligent for failing to warn her of a number impending special levies.

The claim was dismissed.  The Court said that the evidence did not establish negligence on the part of the agent.  The Court also said:

… a purchaser of real estate should carefully review all of the documents before signing them.  A purchaser has some responsibility to protect their own interests and cannot simply put their trust totally in a real estate agent.
