Court can order eviction of owner
Can an owner be evicted as a result of substantial breaches of the condominium’s by-laws.
Section 55 of the Condominium Property Act contains specific provision for eviction of tenants. There is no similar specific provision in the Act with respect to eviction of owners. Nevertheless, Section 67 gives the court general discretion to give directions and to make any other order that the court considers appropriate in the circumstances. This gives the court the authority to order the eviction of an owner where the court deems just.
