Court upholds condominium’s by-law to authorize leasing of unallocated parking to owners
The lower Court upheld the condominium corporation’s by-law authorizing leasing of unallocated parking to owners. [See Condo Cases Across Canada , Part 56, November 2016]
The Applicant owner appealed. The Court of Appeal dismissed the appeal. The Court of Appeal agreed with the lower Court that the by-law was fair and reasonable, and was not oppressive to the owner.
