The applicant operated a restaurant as a tenant of one of the units in the respondent condominium. He alleged that the condominium corporation had targeted him for stricter enforcement of the corporation’s rules.
The claim was dismissed. The Human Rights Tribunal said:
Overall, the evidence admitted in this case made clear that the parties are engaged in an ongoing commercial dispute. However, … I find that the applicant has failed to satisfy his onus of showing that any of the respondents’ actions or inactions were discriminatory based on his ethnic origin, national origin or race.
