Court grants leave to appeal from decision of Civil Resolution Tribunal
The owner sought leave to appeal a decision of the Civil Resolution Tribunal. The tribunal had found that the strata corporation, in carrying out a renewal project, had not been obligated to rebuild the owner’s solarium (at least at the time of the renewal project).
The Court held that questions of law and other factors justified the granting of leave; and accordingly granted leave to appeal on all grounds asserted by the owner.
