Court dispenses with requirement for party’s consent to registration of condominium declaration
5182353 Manitoba Ltd. (“518”) owned land which it wished to convert to condominium. BNB Real Estates Co. Ltd. owned adjacent property and enjoyed certain rights over 518’s property. 518 required BNB’s consent to the condominium conversion. BNB refused to consent. 518 obtained an order pursuant to section 5(8) of the Condominium Act dispensing with the requirement for BNB’s consent. BNB appealed. The appeal was dismissed.
