Owners responsible for damage to parking space and for reasonable enforcement costs incurred by condominium corporation
The CAT found that the owners had caused damage to their exclusive-use common element parking space, due to leaking oil. This was a contravention of the condominium corporation’s governing documents. The CAT ordered that the condominium corporation was to be permitted to access the parking space to carry out necessary cleaning / repairs. The owners were ordered to pay the resulting cleaning / repair costs (subject to an indicated upper limit). The owners were also ordered to pay certain legal costs incurred by the corporation in relation to pre-CAT enforcement efforts.
