Tribunal dismisses claim for discrimination on the basis of creed because of alleged religious (Christian) symbols

The Applicant, a resident in the condominium, claimed that certain symbols displayed by the condominium corporation – including a tree, lights, poinsettias, a candy cane and Santa hat – were associated with and evocative of Christmas and accordingly discriminated against her (as a non-Christian) on the basis of creed.

 

The Human Rights Tribunal dismissed the claim.  The Tribunal said:

 

The onus is on the applicant to prove her case. She has not provided evidence on which I can find that the decorations in question are religious symbols, nor that the respondent has discriminated against her by unequal recognition of religious holidays. She has, as such, not been able to establish discrimination on the ground of creed.
