Office of Residential Tenancies refuses to terminate tenancy

The condominium corporation sought an order for possession of one of the units pursuant to Section 80 of The Condominium Property Act, 1993 and Sections 68 and 70 of the Residential Tenancies Act, 2006.  The condominium corporation’s application was based on misconduct of persons allegedly allowed onto the property by the tenant of the unit.

The Office of Residential Tenancies refused the requested order because the persons in question had not been permitted onto the property by the tenant and/or because the misconduct was not so serious as to justify the requested order.
