The lower Court refused the commercial owner’s request for an amendment to the Declaration (to amend provisions that deny the commercial owner the right to use certain recreational amenities).  [See Condo Cases Across Canada, Part 59, September 2017.]

 

The owner appealed, and the appeal was dismissed.
