Former Director not entitled to compensation for arranging loans for corporation

A former Director claimed fees for services rendered in relation to loans arranged for the condominium corporation.  The Court dismissed the claims for the following reasons:

  • There was no intention to form a contract for the services;
  • There was no entitlement to payment based upon quantum meruit;
  • For some of the claims, the limitation period had expired;
  • The Plaintiff was not entitled to charge the fees based upon Section 22 of the Real Estate Act.
