Court summarily dismisses developer’s claim against condominium corporation for a claimed right to proceed with a second phase
The developer claimed the right to build and sell a second building on a portion of the condominium property. The second building was allegedly phase 2 of the developer’s total planned development. The condominium corporation applied for summary dismissal of the claim and was successful because the developer had failed to register a Developer’s Reservation against Title, pursuant to section 16 of the Condominium Property Act, 1993.
