Condominium corporation agrees to allow hot tub

Due to the owner’s medical condition, the condominium corporation agreed to allow the owner to keep a hot tub on the unit’s exclusive use common elements, subject to various conditions, including the following: 

  • The owner would provide proof of insurance on the hot tub, in an amount of $2 million.
  • The owner agrees to indemnify the condominium corporation for any bodily or personal injury or damage to property caused by the hot tub.
  • If the unit is to be sold, the hot tub must be removed.
