No Human Rights claim against directors; name of corporation respondent corrected
The applicant alleged that the respondents had failed to reasonably accommodate her disabilities. In the application, the applicant named the “Board of Directors of Halton Condominium Corporation No. 41” as a respondent. On an interim basis, the Tribunal dealt with two issues:
a) What is the proper name of the condominium corporation respondent?
b) Should the individual directors be added as respondents to the claim?
The Tribunal said that the name of the condominium corporation respondent should be “Halton Condominium Corporation No. 41”. The Tribunal also refused to add the individual directors as parties. The Tribunal said:
There is absolutely no information contained in the Application or the Reply that would suggest that any individual Board members were acting outside the scope of their duties as Board members in this case. In the circumstances of this case, I find that there is no basis on which it would be appropriate to award a remedy against individual Board members if a Code infringement is found
