Saulnier v. Le Syndicat des Copropri̩taires de Domaine de L'Avenir - Phase I (Cour sup̩rieure du Qu̩bec District de Laval)

One of the owners in the syndicat sought rights to an interior parking space (instead of the exterior parking space that had been allocated to his unit).  The owner’s claim was dismissed.  The Court’s reasons included the following:

• The owner was not entitled to an interior space under the terms of the Declaration.
• The previous owners of the unit had not objected to the parking allocation during a period of at least 10 years since the creation of the syndicat.
• The owner had not included other owners as Respondents to the proceeding.
