Syndicate awarded $25.00 per day in damages for tenant’s contravention of declaration provision respecting dogs

The syndicate’s declaration stated that only dogs less than 9 kilograms could be kept in a unit.  The declaration also included a provision entitling the syndicate to a penalty of $25.00 per day during any contravention.   

The owner’s tenant kept a dog that exceeded the weight limit.  As a result, the Court awarded damages to the syndicate in the amount of $3,425 (being $25.00 for each day of the contravention).
