Court grants owner’s application to amend Declaration

An owner applied, under section 109 of the Condominium Act 1998, to amend the Declaration in relation to the permitted use of the owner’s unit.  The Court granted the application (on the grounds that there was an error in the original Declaration).  Although the condominium corporation unsuccessfully opposed the application, the Court did not award any costs. [The owner accordingly paid the costs for the amendment application.]
